~2016 - Multiple Dwellings on One Lot

In memo from Town Council Kreiger dated September 14, 2016, Attorney Kreiger stated that the Bylaw allows for multiple dwellings on one lot based on the wording in Section 410.1.1, 401.2(5), 530.1, 530.2.3 and 560.3.2.

John Baldwin filed an ANR for a two lot site plan with the Planning Board on September 21, 2016. The ANR was for two lots and was granted based on 200 feet of frontage on North Street for Lot 1, 700 feet of frontage on North Street for Lot 2 and 827 feet of frontage on Keene Street for Lot 2. Lot 2 does not have access to a public way besides going through Lot 1 or a driveway that is not on the plans to get to Keene Street but the ANR was granted.

Later, John Baldwin received six building permits to put one house on Lot 1 and five houses on Lot 2. Typically, a development of this size would be a subdivision and would need to follow subdivision law.

Subdivision Control Law incorporates the following protocols that were not required in this circumstance based on the interpretation of the bylaw:

Design standards

Drainage calculations

Infrastructure considerations

Address public safety concerns (emergency vehicle access, etc.)

Protection of natural water resources

Protect nature beauty and character of the town
